On July 21, 2023, OSHA issued a final rule amending 29 CFR 1904.41, Electronic Submission of Injury and Illness Records to OSHA. Employers with 250 or more employees, as well as employers in certain industries with between 20 and 249 employees, are still required to submit information annually from their OSHA Form 300A - Summary of Work-Related Injuries and Illnesses, to OSHA through their Injury Tracking Application (ITA).

This revision adds the requirement for employers in certain industries with 100 or more employees to submit information from their OSHA Form 300 - Log of Work-Related Injuries and Illnesses and OSHA Form 301 – Injury and Illness Incident Report, annually to OSHA through the ITA. In addition, OSHA updated Appendix A, which designates the industries with between 20 and 249 employees that are required to submit OSHA Form 300A data, and added Appendix B, which lists the industries that are designated to report injury and illness data from their OSHA Forms 300 and 301. OSHA also added the requirement that all establishments will be required to provide their company name when making electronic submissions to OSHA.

In accordance with 13 NCAC 7A .0301(a), the N.C. Commissioner of Labor automatically adopted the federal Recording and Reporting Occupational Injuries and Illnesses Standard with an effective date of January 1, 2024.
