On May 12, 2016, OSHA issued a final rule (Federal Register) revising 29 CFR 1904.41 - Electronic submission of Employer Identification Number (EIN) and injury and illness records to OSHA, by requiring employers in certain industries to electronically submit to OSHA injury and illness data (ITA) that employers are already required to maintain under existing OSHA regulations. The frequency and content of these establishment-specific submissions is dependent on the size and industry of the employer. OSHA intends to post data collected through these submissions on a publicly accessible website, but will remove any information that can be used to identify individual employees. In accordance with 13 NCAC 7A.0301(b), the N.C. Commissioner of Labor automatically adopted the federal Recording and Reporting Occupational Injuries and Illnesses Standard with effective dates of August 10, 2016 (for §§ 1904.35 - Employee involvement and 1904.36 - Prohibition against discrimination) and January 1, 2017 (for § 1904.41 - Electronic submission of Employer Identification Number (EIN) and injury and illness records to OSHA).
