On June 30, 2003 (Federal Register), federal OSHA issued an amendment to the final rule deleting two provisions of the rule published January 1, 2001. The effective date of these provisions has been delayed since the original publication of the rule in 2001; consequently, the requirements deleted by this final rule have never been in effect. 29 CFR 1904.12, “Recording criteria for case involving work-related musculoskeletal disorders,” is deleted in its’ entirety. In 29 CFR 1904.29(b)(7)(vi), the first sentence is revised to read, “Other illnesses, if the employee voluntarily requests that his or her name not be entered on the log.” The second sentence, “Musculoskeletal disorders (MSD’s) are not considered privacy cases” is deleted from this paragraph.

In accordance with 13 NCAC 7A.0301(b), the N.C. Commissioner of Labor automatically adopted the federal Recording and Reporting Occupational Injuries and Illnesses Standard with an effective date of January 1, 2004. R
