CFR 134 - Asbestos

On August 10, 1994, Federal OSHA promulgated the new final rules for Occupational Exposure to Asbestos (Federal Register). These final standards amend the OSHA standards issued on June 17, 1986 for occupational exposure to asbestos in general industry and construction. In addition, they include a separate standard covering occupational exposure to asbestos in the shipyard industry at 29 CFR 1915.1001. Major revisions include a reduced time-weighted-average permissible exposure limit of 0. 1 fiber per cubic centimeter (f/cc) for all asbestos work in all industries, a new classification scheme for asbestos and shipyard industry work which ties mandatory work practices to work classification, a presumptive asbestos identification requirement for "high hazard" asbestos containing building materials, limited notification requirements for employers who use unlisted compliance methods in high risk asbestos abatement work, and mandatory methods of control for brake and clutch repair.

These final rules at 29 CFR 1910, 29 CFR 1915 and 29 CFR 1926 were adopted verbatim in North Carolina by the Commissioner of Labor with an effective date of February 1, 1995, and corresponding delayed start-up dates under 1910.1001(o)(3), 1915.1001(q)(3) and 1926.1101(q)(3) within the standards themselves.
