On June 30, 2021, OSHA issued a memorandum on “Enforcement Inspection Guidance for Tree Care and Tree Removal Operations” to compliance safety and health officers (CSHOs) inspecting employers engaged in tree care and tree removal operations. Per this memorandum, the OSH Division adopts the above-mentioned OSHA enforcement inspection guidance memorandum for use in North Carolina. It reference 29 CFR 1910.67 - Vehicle-mounted elevating and rotating work platforms, 29 CFR 1910, Subpart D - Walking - working surfaces, 29 CFR 1910, Subpart I - PPE, 29 CFR 1910.140 - Personal fall protection systems, 29 CFR 1910, Subpart S - Electrical, 29 CFR 1910.269 - Electric power generation, transmission and distribution, 29 CFR 1910.268 - Telecommunications, 29 CFR 1910.106 - Flammable liquids, 29 CFR 1910.95 - Occupational noise exposure, 29 CFR 1910, Subpart N - Materials handling and storage, 29 CFR 1910.180 - Crawler locomotive and truck cranes, 29 CFR 1926.1431, 29 CFR 1910, Subpart P - Hand and portable powered tools, 29 CFR 1910, Subpart O - Machinery and machine guarding, 29 CFR 1910.151 - Medical services and first aid, 29 CFR 1910.157 - Portable fire extinguishers, traffic safety [NCGS) 95-129(1) - General Duty Clause], and roll-over protective devices[NCGS) 95-129(1) - General Duty Clause].
