CFR 175 - Roll-Over Protective Structures

In 1996, federal OSHA issued technical amendments (Federal Register) revising the standards that regulate testing of roll-over protective structures (ROPS) used to protect employees who operate wheel-type tractors. This revision removed the original ROPS standards and replaced them with references to national consensus standards for ROPS-testing requirements. On December 29, 2005, federal OSHA issued a direct final rule to reinstate the original ROPS standards. The reinstated ROPS standards for both construction (29 CFR 1926.1002, 29 CFR 1926.1003, 29 CFR 1926 Subpart W) and agriculture (29 CFR 1928.51, 29 CFR 1928.52, 29 CFR 1928.53, 29 CFR 1928 Subpart CAppendix B) also contain a number of minor revisions that OSHA believes are not substantive and will improve comprehension of, and compliance with, the standards. The N.C. Commissioner of Labor adopted this final rule verbatim with an effective date of May 30, 2006.
