On July 3, 2002, federal OSHA promulgated technical amendments to the final rule, 29 CFR 1915, “Occupational Safety and Health Standards for Shipyard Employment.” These standards contain a number of minor typographical, grammatical and other errors. This document corrects those errors, as well as several inaccurate cross-references. The cross references are being changed because the referenced section numbers have changed or have been removed as a result of prior revisions to the rule.

The N.C. Commissioner of Labor adopted the technical amendments to the federal Occupational Safety and Health Standards for Shipyard Employment standard verbatim. Refer to the July 3, 2002, Federal Register (Vol. 67 FR No. 128) for the details related to these requirements. Also reference Federal Register, 58 FR 35512 7/1/93; 1915.5 (Incorporation by reference) - amended; 1915.12 (Precautions and the order of testing before entering confined and enclosed spaces and other dangerous atmospheres) - revised; 1915.99 - redesignated to 1915.1200 - Hazard Communication. Subpart Z revised. 

In North Carolina, the OSH Division has authority over public sector shipyard employment activities on inspected vessels if the work is performed by public sector shipyard employees (non-crew members). The U.S. Coast Guard regulates working conditions for seamen (crew members) on inspected vessels while Federal OSHA has authority to cite private sector shipyard employment activities on inspected vessels if the work is performed by shipyard employees (non-crew members).

On uninspected vessels, the OSH Division has authority to cite public sector shipyard employers for all working conditions. The OSH Division can also cite the owners or operators of uninspected vessels for violations involving shipbuilding, shipbreaking, and ship repair operations regardless of whether the work is performed by seamen (crew members) or by non-crew members unless the hazards are covered by U.S. Coast Guard regulations.
