On December 1, 1998, federal OSHA promulgated a final rule to amend 29 CFR 1910.146 permit-required confined spaces, and a minor correction was published on January 4, 1999. The amended standard provides for enhanced employee participation in their employer's confined space entry program, including the opportunity to observe related testing and monitoring. The amended rules also clarify the criteria that employers must satisfy when preparing for the timely rescue of incapacitated permit space entrants. Employers must be in compliance with these amended requirements by August 1, 1999.

The N.C. Commissioner of Labor adopted the amended federal safety standard verbatim with an effective date of February 22, 1999. Refer to the 12/1/98 and 1/4/99 Federal Registers for the details related to these requirements.
