On October 29, 2008, federal OSHA issued this final rule (Federal Register) to clarify the scope of section 1910.304(b)(3)(ii) and to address questions raised by stakeholders. In addition, this final rule also corrects two typographical errors located elsewhere in the rule. The N.C. Commissioner of Labor adopted the final rule clarifications and correcting amendments verbatim with an effective date of April 23, 2009.
